Terms and Conditions

1. Designations.
The person who books any activity or service offered on www.tucmountainguides.com or on any other commercial strategy used by the company TUC Esquí, Trekking y Alpinismo, S.L., from now on “TUC Mountain Guides” is hereinafter referred to as "Client".

2. Acceptance.
The assistance at any activity organized or conducted by Tuc Mountain Guides, implies the acceptance of the terms and conditions set out in this document. After filling in the form for the first time, required to attend any of the Tuc Mountain Guides activities, the subsequent acceptance of the terms and conditions is assumed for all future participations. Tuc Mountain Guides will inform at any time of any variation, inclusion or cancellation on any of the different paragraphs as well as the client will do so if modifications on the personal details.

3. Right of admission.
Tuc Mountain Guides reserves the right of admission in any of their activities, even if it has begun, for those people who, due to an inadequate physical condition or technical training, prevent the normal development of the activity or endanger their physical integrity, that of the participants or the guides.

4. Personal documentation.
All clients, without exception, must carry their original and valid personal documentation necessary to travel to the country or countries visited. Minors under 18 years of age must bring with them a written authorized permission to travel signed by their parents or guardians in case that it may be requested by any authority.
If special documents are required (visas, vaccination certificates, etc.) to travel to the destination, it is the client's responsibility to obtain them. The client assumes the consequences of not carrying them or invalidity.
In the event of any authority rejecting the required documentation, Tuc Mountain Guides declines all responsibility in any extra costs that the client will be involved. In these circumstances the conditions and rules established for voluntary rejection of contract will apply.

5. Insurance.
Under current law, any person hiring any activity offered by TUC Mountain Guides is entitled to posses an appropriate accident insurance.
Tuc Mountain Guides offers to all its clients an accident insurance for each of their activities, although, for the ones taking place outside Spain, the client will be required to hold a federative licence in mountain and climbing sports covering the geographical area and activity in question.

6. The guide.
The Tuc Mountain Guides who lead the TUC mountain activities are qualified professionals in accordance to the current legislation with the entire knowledge necessary to carry out the activity or activities contracted by the client. The main task of the guide is to ensure the success of the activity and the safety of every participant. In this sense, although every opinion regarding the different situations that may arise during the development of the activity are valued, the guide will be the one making the final decisions on any matter that affects the operation of the activity or safety of the participants.
If the client's inattention to the guide's instructions entails an obvious risk for the whole group, one of its members or for the client himself, he will be entirely responsible for the possible consequences.
The guide will have the authority to request the evacuation of a client for reasons of illness, accident or any other that compromises the safety of the group or the client. In this case, the client will not be able to claim any refund, regardless of what he may subsequently claim from his insurance company.

7. Loan and rental of equipment.
In the event that Tuc Mountain Guides rents or lends equipment to its clients to carry out an activity, any damage, with the exception of possible wear of normal use, or loss of the rented or lent equipment will be assumed by the client.
In the event that the client rents equipment to third parties, Tuc Mountain Guides will not be held responsible for the conditions of the hired equipment or the efficiency of the rental company, even if Tuc Mountain Guides has acted as an intermediary.

8. Personal equipment.
The client is required to have the appropriate equipment pointed out by the guide. This equipment must be in perfect state of use and must match the appropriate size for the client. This includes both technical clothing and gear specific to the activity, as well as safety equipment for skiing (shovel, DVA and probe).
In case of any irregularity on the personal equipment or absence of it noticed at the beginning of the activity, the guide will be obliged to exclude this person from the activity without having the right to a refund of any percentage of the price of this activity.

9. State of health.
The client agrees to inform Tuc Mountain Guides or the guide leading the activity, in writing and on time, of any circumstance associated to his/her health that could affect the normal development of the activity, such as: allergies, phobias, behavioural disorders, cardiovascular diseases, important medical interventions, mobility limitations, or any medical recommendation related to the practice of sports that the client may have. This information must be stated before hiring any activity and will be considered confidential in all cases.
The client also agrees not to show to the activity under the effects of alcohol, drugs or any other medication that may affect its reflexes or its physical and intellectual performance.
The violation would automatically entail the loss of any right by the client, on a hypothetical later claim.

10. Knowledge of the activity.
The participant of any mountain activity offered on the website or in any other commercial network used by Tuc Mountain Guides states to be aware that risks are involved and unforeseeable consequences could happen. Mountain environment is characterized by being changing and subject to a multitude of uncontrollable variables.
The client acknowledges that he or she has been informed by Tuc Mountain Guides of the activity details (physical, technical, psychological, needed equipment, place, timetables, duration etc.) and takes part on it with full knowledge of them.

11. Reservation, payment and cancellation policy.
1-For 1-day services:

In order to confirm a reservation a deposit of 120€ is required. Final payment is due 48 hours prior to the beginning of the activity.
In case of cancellation received up to 7 days prior to the beginning of the activity the deposit will be refunded. If cancellation is received between 7 days and 48 hours, the deposit will be forfeited. Note that for cancellations received within 48 hours prior to the beginning of the activity
all deposits and tariffs are forfeited.

Failure by the client to show at the place and time scheduled for the start of the activity, will result in the total loss of the amount paid for that activity.
The client accepts the rate of the hired services, regardless of the number of participants attending, last minute variations that could affect the price charged to each participant due to the withdrawal, voluntary or not, of a participant.

2-For services from 2 to 7 days:

To confirm a reservation a deposit of 50% of the total price is required. The remaining 50% must be paid the latest 15 days prior to the start of the activity.
Failure to follow these deadlines will be understood as a voluntary rescission and the cancellation policy will apply.

Cancellation policy:
10% is forfeited if cancellation is received 25 or more days prior to the beginning of the services.
30% between 25 and 7 days
60% between 7 days and 72 hours
100% less than 72h

In the event that Tuc Mountain Guides or the person responsible for the activity had to take the decision to cancel the activity before the start of it, for any reason related to weather conditions, mountain conditions, safety conditions or any other cause that in its opinion was determinant, the client would be entitled to a refund of the total amount paid except for the 5% of service fee.

3-For services of longer duration than one week:

To confirm a reservation a deposit of 50% per person is required. It must be paid at least 60 days prior to departure. The remaining 50% must be paid no later than 30 days prior to departure. In the event of accepting a reservation within 30 days prior to the departure date, the total amount of the services will be charged to confirm it.

Cancellation policy:
40% is forfeited if cancellation is received more than 50 days prior to departure
50% between 50 and 21 days
75% between 21 days and 72 hours
100% less than 72h

In the case of a participant being unable to attend, he or she may propose another person to replace him/her to avoid the forfeits. This person must be in good conditions, both physical and technical, to carry out the activity.

If during the contracted activity, Tuc Mountain Guides or the guide responsible is obliged to modify or cancel the activity due to security reasons, weather conditions, mountain conditions, complications on the country in question, the extra costs that this may cause will be assumed by the participants.

Tuc Mountain Guides will not make any refunds for non-used services whatever the cause will be.

All cancellations must be made in writing by email to info@tucmountainguides.com or by text message to 0034 680723858.

12. Price.
The prices are shown in Euros (VAT included)
In some of the website programmes, the prices shown correspond to a minimum number of participants. If that number is not reached but the interest to accomplish that program still there, Tuc Mountain Guides will calculate the selling price so that is viable with a lower number of clients.
Unless otherwise stated, only the guide services are included in the price of the programs. The additional costs such as accommodation, transport prior to, during and after the activity, meals, ski lifts or any other need, will be paid by the participants. They will also take care of the expenses of the mountain guide or guides.

In case of variations or even cancellations of the programs, due to weather or mountain conditions, as well as a result of the decision of the mountain guide responsible of the participants, the price will remain unchanged. It could even be increased if other route or program with higher costs is agreed.

13. Method of payment.
Payment can be made via cash or bank transfer. No credit cards will be accepted.

14. Protection of Personal Data.
TUC ESQUI TREKKING Y ALPINISMO, S.L. COMMITS TO PROCESS ALL YOUR PERSONAL DATA IN AN ABSOLUTELY CONFIDENTIAL MANNER.

The right to one's own image is recognised in article 18.1 of the Constitution and regulated by Law 5/1982, of 5 May, on the right to honour, personal and family privacy and one's own image, this document gives consent to TUC ESQUI TREKKING Y ALPINISMO, S.L. to capture your own image, either
through cameras or video cameras, in which the affected person is clearly identifiable. The exercise of capturing images (or videos) by TUC ESQUI TREKKING Y ALPINISMO, S.L. or another delegated company, will be limited to the set of activities developed within the scope of their professional
activity and may be published on the company's social networks, web, brochures, magazines, etc. TUC ESQUI TREKKING Y ALPINISMO, S.L. commits to adopt at all times the appropriate security measures to prevent access, transfer or unauthorized use of images.

We inform you that the personal data will be added on a data processing owned by TUC ESQUI TREKKING Y ALPINISMO, S.L.
